Terms of Service
1. Acceptance of Terms
By accessing and using Seth Brand Tech Consulting (SBTC) services, you accept and agree to be bound by the terms and provision of this agreement.
2. Services Description
SBTC provides the following services:
- Website design and development
- Tool integration for existing websites
- Brand positioning and visual direction as part of website projects
- Website maintenance and support
- Technical consulting and guidance
3. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information for your project
- Respond promptly to requests for feedback and approvals
- Provide necessary content, images, and materials in a timely manner
- Ensure you have rights to use any content you provide
- Make timely payments as outlined in your service agreement
4. Payment Terms
Payment terms are as follows:
- 50% deposit required to begin work on most projects
- Final 50% due upon project completion before delivery
- Monthly services billed in advance
- All payments are non-refundable except as specified in writing
- Late payments may incur additional fees
5. Project Timeline
Project timelines are estimates based on client cooperation and timely feedback. Delays caused by client response times or content delivery may extend project completion dates.
6. Revisions and Changes
Each project includes a specified number of revisions as outlined in your service agreement. Additional revisions beyond the included amount will be billed at the current hourly or project rate stated in your agreement.
7. Intellectual Property
Upon final payment, clients receive ownership of the final deliverables. SBTC retains rights to:
- Use the project in our portfolio
- Reuse code, techniques, and processes for other clients
- Retain ownership of tools, software, and systems developed
8. Confidentiality
Both parties agree to keep confidential all proprietary information shared during the course of business. This includes but is not limited to business strategies, customer lists, and technical information.
9. Limitation of Liability
SBTC shall not be liable for any indirect, incidental, special, or consequential damages resulting from our services. Our total liability shall not exceed the amount paid for the specific service in question.
10. Termination
Either party may terminate the agreement with written notice. Clients are responsible for payment for all work completed up to the termination date.
11. Warranty
SBTC will perform services in a professional manner. Any support window, revision period, or post-launch assistance is limited to what is specifically stated in your quote, checkout, or service agreement.
12. Third-Party Services
SBTC is not responsible for the performance, availability, or policies of third-party services including hosting providers, domain registrars, or software platforms.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
14. Changes to Terms
SBTC reserves the right to modify these terms at any time. Changes will be effective immediately upon posting to our website.
